GENERAL TERMS & CONDITIONS OF DASH OF DARING


Clause 1 | General

1.1  The General Terms and Conditions of Dash of Daring (hereafter referred to as the ‘Conditions’) apply to all offers, orders, agreements and deliveries made by or with Dash of Daring (DOD). By placing an order you agree to be bound by these Conditions. If you ask, a copy of these Conditions can be sent to you free of charge. 

1.2 It’s only possible to deviate from these Conditions if agreed in writing. In this case all the other provisions remain in effect.

1.3 Only persons aged 18 years or older, who are not under guardianship are able to place an order.

1.4 Whether products or services are offered at dashofdaring.nl, does not warrant that these products or services are available at any time. We reserve the right to withdraw products.

Clause 2 | Agreement, Order and Delivery costs 

2.1  The agreement becomes binding at the time that you place your order by clicking the ‘Place order’ button on the order form (the last form in the order process, with the item description and billing address). Once your order’s been placed, DOD processes it by means of the order form on the website. You’ll receive an email confirming your order at the email address you’ve given. Even if you don’t receive an email, your order still remains in effect. 

2.2 All prices quoted by DOD are in euros and include 21% VAT. DOD is entitled to adjust its prices. The adjustments apply from the time they’re published on the website and don’t apply to items that have already been ordered.

2.3 DOD charges no delivery costs for deliveries within the Netherlands. Delivery costs per European country vary.

2.4 Prices on the website and in store may vary.

2.5 All prices on the website are subject to misprints. For the consequences of misprints no liability is accepted.


Clause 3 | Delivery


3.1 DOD is extremely careful with the registration and processing of orders and strives to deliver your order to your home address or collection point in the Netherlands, in accordance with your chosen delivery method.

3.2 When your order is to be delivered within the Netherlands, DOD does its best to send it within 24 hours of receipt of payment. The item will be delivered within 1 to 3 days after you ordered it. If this isn’t possible (because, for example, your order is temporarily out of stock) or an order can only be met in part, then you’ll be notified within 48 (forty-eight) hours of the order being placed. In this case you’re entitled to cancel your order without having to pay anything. 

3.3 DOD strives to ship your order within 24 hours after receiving the payment. Although we aim to deliver within the deadline, delays may result from unexpected events.

3.4 The delivery takes place subject to availability.

3.5 The place of delivery is the address that the consumer provided to DOD.

3.6 If you’ve given DOD the wrong delivery address, then you’ll have to pay the extra delivery costs yourself. 

3.7 You’re obliged to take delivery of the purchased items at the time they’re delivered to you.

3.8 All time limits mentioned on the website are indicative. From the mentioned terms are therefore not legally binding.


Clause 4 | Cancellation of an order

4.1  DOD does its best to ensure that its customers are happy with their purchases. If you’re not satisfied with your purchase, you have 14 (fourteen) days from the date on which you receive the item to return it, without giving any reason, to:

4.2 You can dissolve the agreement or return the items. You need to inform DOD of this within 14 (fourteen) days via the return form that’s included in your delivered package. You will need to fill in the return form and send this back to us with the items you have ordered.  

4.3 If the customer after 14 days has not returned the delivered items to DOD, the purchase is a fact.

4.4 DOD guarantees a full refund or replacement if required (if available) of returned items pursuant to section 4 (cancel an order), provided that all items be returned in the same condition they were in when received. This implies that the articles are not damaged, dirty, washed, modified, or performed (other than the fit of the item) may be, and that labels or price tags have not been removed.

4.5 You will have to prove that the goods are returned on time, for example through a proof of postal delivery.

4.6 You yourself are responsible for the cost of returning the items. However, you have the opportunity to deliver your package free of charge at our store on the Oude Binnenweg 42 in Rotterdam.

4.7 If you return the entire order and you have already paid, you will receive the amount excluding shipping costs from DOD. Once the item has been received and checked, your money, less delivery and packaging costs, will be refunded within 14 (fourteen) days.

4.8 If a received item is defective, let DOD hereof know immediately and send back the article as set put in paragraph 4 (revoke an order). All products as defect notification, on the condition that this is done within seven days, are refunded by DOD. The provisions in these conditions do not restrict any legal rights.


Clause 5 | Shipment and Transport

5.1  DOD is responsible for damage, theft or loss which occurs during the shipment of the items. The risk passes to you at the time of delivery. 

5.2 DOD sends packages via parcel post service of MYPARCEL. 


Clause 6 | Payment and Payment Methods

6.1  At  DOD you can choose between 3 (three) safe methods of payment: iDeal, Credit Card and Bancontact.

6.2  Payments using iDEAL are processed via Mollie secure procedure. Mollie is one of the most reliable Payment Service Providers in the Netherlands.

6.3  You can pay with credit card via the Credit card payment option. If you choose this payment option, then your payment will be processed via a secure Mollie connection. 

6.4. Payments for Belgian customers can be processed via a secure Bancontact connection. 

6.5 DOD retains full ownership of all the delivered items until such time as the purchase price and any other amounts due to DOD have been paid in full. 


7. Clause 7 | Liability

7.1 Liability on the part of DOD for direct or indirect damage caused by an item purchased from it is in any case limited to an amount equal to the selling price of that item, unless and in so far as there has been malice or gross negligence on the part of DOD.

7.2 DOD is not responsible for indirect losses that are a side effect of the original loss of the original damage, such as loss of profits or loss of opportunity, or non-delivery of goods or failure to comply with any other obligation under this Conditions if such failure is due to events beyond our control, including but not limited to for example: fire, flood, storm, rebellion, political unrest, war, nuclear accidents and terrorist activities.

7.3 Our maximum liability to you for any loss or damage which arose of your order on uncwardrobe.com is limited to the total amount of your order.

7.4 All images; photos, videos, etc. ; information on weights, colors, graphics, labels, etc. on the DOD website are only approximate and indicative and may not lead to damages or rescission of the contract.


Clause 8 | Force Majeure


8.1  For the purposes of this clause, force majeure means all shortcomings which cannot be attributed to DOD or can not be restricted under legislation. 

8.2  If DOD is unable to meet its obligations due to force majeure, those obligations will be suspended for the duration of the state of force majeure. After 30 (thirty) days both parties have the right to dissolve the agreement either in whole or in part by means of a written declaration, without being entitled to any damages or compensation.


Clause 9 | Guarantee


9.1 DOD guarantees that the items to be delivered by us meet the usual requirements and norms which can reasonably be expected at the time of delivery and that they are fit for the purposes for which items of the same type are normally used in the Netherlands. If the items are to be used outside the Netherlands, you yourself need to check that the item is fit for use there.

9.2 You are required  need to check the delivered item at the time of its delivery, and certainly within the set ‘cancel an order’ period of 14 (fourteen) days. When doing this, you should make sure that the quality and quantity of what has been delivered corresponds with what was agreed, and at least meets the requirements which apply to it in normal trade. Should the delivered item(s) are incorrect or incomplete, you are required (before proceeding to return to DOD) to inform these defects immediately by e-mail to DOD. Any defects or faulty goods should and can be confirmed at the latest up to seven days after delivery at DOD by email.

9.3 If clothing is damaged after being worn, after discovery of failure, damage occurring after wearing, does expire the right to claim and return.

9.4 This warranty does not apply if: 1) as long as the purchaser against DOD is in default; 2) the customer has repaired the delivered goods themselves and / or processed by third parties to repair and / or editing; 3) the delivered goods have been exposed to abnormal conditions or otherwise carelessly handled or treated in violation of the instructions of DOD and / or instructions on the packaging.

9.5 Once the guarantee period referred to in Clause 4.1 has expired, DOD is entitled to charge all repair or replacement costs, including administrative, delivery and call out charges. 

9.6 When purchasing articles in the dashofdaring.nl-webshop, the guarantee law applies. Legal guarantee means that the product must do what the consumer can reasonably expect. There is no legal time limit on this guarantee because what the consumer expects, differs per product.


Clause 10 | Colors

10.1 We do everything reasonably possible to the features of our products, including the composition and display colors as accurately as possible.

10.2 The color you see will depend on your computer system, and DOD can not guarantee that your computer will displays colors correctly.


Clause 11 | Privacy & Data management

11.1 If you place an order at DOD, your data will be included in the customer base of DOD. In line with the Data Protection Act, your data will not be provided to third parties.

11.2 DOD respects the privacy of her website users and ensures confidentiality of your personal information.

11.3 DOD can use a mailing list if you subscribed. Each mailing includes instructions to remove yourself from this list.


Clause 12 | Copyright photos and images


12.1  All the photos and images which (will) appear on DOD are protected by copyright, regardless of the manner in which they’re disseminated or the form in which they’re delivered. It’s not allowed to publish or copy the photos or images in any way whatsoever without written consent from DOD. 

12.2  If you go ahead and use a photo or image anyway without prior written consent from DOD, you’ll be summoned to desist and a claim for damages will also be lodged against you.  


Clause 13 | Transfer

13.1 DOD reserves the right to any claims for payment (including any payment) to be transferred, in associated with the delivery of goods, to a third party.


Clause 14 | Severability

14.1 The any part(s) of these Conditions were to be invalid or annulled by a court or regulator, the remaining conditions remain effective.

Clause 15 | Disputes

15.1  All legal relationships to which DOD is a party are governed exclusively by laws of the Netherlands, even if an agreement is going to be executed in whole or in part abroad or if the other party to the legal relationship has a residence there. 

15.2  Disputes arising from an agreement between DOD and client, which can not be resolved by mutual agreement, the dispute must be brought before a competent court in the district of Rotterdam, unless DOD prefers to give the difference to the competent court or the place of residence of the purchaser subdue.
